Penalities for Tobacco Sale Violations


Sec. 1-7. General penalty; continuing violations.

(a) Notwithstanding the provisions of any other ordinance of the city or provision of this Code to the contrary, whenever in this Code or any other ordinance of the city an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, and no specific penalty is provided therfor, the violation of any such provision of this Code or other ordinances of the city shall be punished by a fine of not more than $500.00 or by imprisonment in jail for a period not exceeding 180 days, or both such fine and imprisonment.

(b) Every day an violation of this Code or any other ordinance of the city shall continue, such violation shall constitute a separate offense.

(c) In no event shall any person be imprisoned for a period of more than 180 days for a violation of this Code or any other ordinance of the city, whether such inprisonment shall be because of sentence of imprisonment or because of failure to pay a fine imposed, or because of both such a sentence and failure to pay a fine imposed.

[Note: The second offense is a minimum fine of $50.00 plus court costs. Court costs are currently $37.50 but are subject to change.]
